User Agreement
1. General Provisions
1.1. This User Agreement (hereinafter referred to as the 'Agreement') regulates the relationship between the LLC Booking Systems (hereinafter referred to as the 'Operator' or 'Company') and the User (hereinafter referred to as the 'User') using the online service Booka.kg (hereinafter referred to as the 'Service').
1.2. This Agreement comes into force from the moment of the User's registration on the Service.
1.3. By using the Service, the User fully accepts this Agreement. If the User disagrees with any of its terms, they must cease using the Service.
2. Registration and Account
2.1. To access the Service, the User must register, providing accurate information.
2.2. The User is fully responsible for the security of their login details and agrees not to share them with third parties. The Operator is not responsible for any losses arising from unauthorized use of the account.
3. Services Provided
3.1. The Service provides a platform for booking services from specialists, including but not limited to:
- Booking appointments with specialists through the online platform
- Booking confirmations and notifications
- The ability to search for specialists by various criteria such as specialization, location, price, rating
- Interactive calendar for managing appointments
- The ability to leave reviews and receive recommendations
3.2. The Operator provides the Service on an 'as is' basis. The Operator does not guarantee uninterrupted operation, accuracy, reliability, completeness, or suitability for any particular purpose.
3.3. The Operator is not responsible for the quality of services provided by specialists, nor for any losses related to the use or inability to use the Service.
4. Limitations of Liability
4.1. The Operator does not guarantee that the Service will be available at all times or that its operation will be error-free and uninterrupted. The Operator reserves the right to suspend the operation of the Service for technical work or for any other reasons without prior notice to the Users.
4.2. The Operator is not responsible for any damages, lost profits, data loss, or any other harm arising from the use of the Service or the inability to use it.
4.3. The Operator does not make any guarantees regarding the quality, availability, or legality of services provided by specialists, and is not responsible for the actions or omissions of the specialists.
5. Use of the Service
5.1. The User agrees to use the Service solely in accordance with the law and this Agreement.
5.2. The User is fully responsible for any information they post through the Service, including but not limited to reviews and chat messages.
5.3. The Operator reserves the right to restrict or terminate the User's access to the Service in case of violation of the terms of the Agreement.
6. Payments and Cancellations
6.1. Payment for specialist services is not processed through the Service using available payment methods. All transactions are made between the User and the specialist, with the Operator acting only as a platform for interaction.
6.2. The cancellation and refund terms depend on the policy of the specific specialist. The Operator is not responsible for refunds or cancellations, as the interaction between the User and the specialist occurs directly.
7. Disclaimer
7.1. The Service is provided 'as is' and 'as available'. The Operator does not provide any explicit or implied warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2. The Operator is not responsible for any damages arising from the use of the Service, nor for the inability to access the Service.
8. Modification of the Terms
8.1. The Operator reserves the right to modify the terms of this Agreement at any time. The User is responsible for independently monitoring changes to the Agreement. Continuing to use the Service after changes means the User accepts the new terms.
8.2. Changes to the Agreement will be published on the website and/or mobile app at least 14 days before they take effect.
9. Final Provisions
9.1. This Agreement is governed by the laws of the Kyrgyz Republic.
9.2. Any disputes arising from the use of the Service will be resolved in the courts of the Kyrgyz Republic at the location of the Operator.
9.3. If any provision of this Agreement is deemed invalid, it will not affect the validity of the remaining provisions.
10. Rights and Duties of Specialists
10.1. Specialists are required to provide accurate information about their services, including prices, schedules, and qualifications.
10.2. Specialists are fully responsible for the quality of the services they provide.
10.3. Specialists are required to use the Service solely for the purpose of providing their services and must not post prohibited content.
10.4. In case of complaints against a specialist, the Operator reserves the right to suspend the specialist's access to the Service until the situation is resolved.
11. User Content Policy
11.1. Users are required to post only truthful reviews. Posting knowingly false information is prohibited and may result in the removal of the review and restriction of access to the Service.
11.2. The Operator reserves the right to delete content that violates the law, moral norms, or this Agreement without prior notice.
11.3. It is prohibited to post content that:
- Violates the intellectual property rights of third parties
- Promotes violence, hatred, discrimination, or illegal activities
- Contains false or misleading information
11.4. Users are responsible for compensating the damages incurred by the Operator due to the posting of prohibited content.
11.5. Users can report content posted on the platform via the contact form or by email. The Operator reserves the right to remove content that violates this Agreement or the law after reviewing the complaint.
12. Privacy Policy
12.1. Personal data is processed in accordance with the laws of the Kyrgyz Republic and the Privacy Policy available on the Booka.kg website.
12.2. By using the Service, the User agrees to the processing of their personal data.
